Welcome to Elevating Traders! These Terms and Conditions ("Terms") govern your use of the services provided by Elevating Traders ("we", "our", or "Elevating Traders"). Please read these Terms carefully before using any of our services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.
1. Eligibility
- Age Requirement: You must be at least 18 years old to use the Elevating Traders services. By registering for an account, you represent and warrant that you are 18 or older.
- Geographic Availability: Our services are available worldwide. However, it is your responsibility to ensure compliance with local laws in your jurisdiction regarding forex and forex education. We reserve the right to restrict access to our services in certain countries if necessary to comply with applicable laws.
- What We Offer: We provide forex education, simulated forex, and financial instrument trading through demo accounts ("Demo Trading"), as well as analytical tools, education, and coaching (collectively, the "Services"), all accessible through user accounts on our Site.
- Educational Purpose: The Services are for educational purposes only and do not constitute financial or investment advice. None of our employees are authorized to provide investment advice. We expressly disclaim any information interpreted as advice.
- Simulated Trading: All trading done through the Elevating Traders services is simulated only and not real trades. Funds provided for demo trading are fictitious. You have no right to withdraw or use demo funds for real trading.
- Service Fees: Fees for Services vary based on the demo account parameters you select as posted on our website. We reserve the right to change fees for future purchases at any time.
- Payment Methods and Term: Payments by credit card are due immediately. For bank transfers, payment is due by the invoice due date. You are responsible for any bank fees incurred.
- No Refund Policy: Except where prohibited by applicable law, all fees are non-refundable except for Elite account holders.
- Registration: To access the Client Portal and Trading Platform, you must register for an Elevating Traders account and choose a username and password. You are responsible for keeping your login credentials secure.
- Unauthorised Access: You must immediately notify us if you suspect any unauthorised use of your account. Elevating Traders is not liable for any loss resulting from unauthorised access to your account.
- Maintenance: Access to the Client Portal and Trading Platform may be unavailable from time to time for maintenance, updates or other reasons. Elevating Traders is not responsible for any damages or losses related to the unavailability of our services.
- Allowable Trades. You may perform any simulated trades through the Trading Platform, as long as they do not constitute Prohibited Trading Practices as defined in section 5.3.
- Reporting of Trades: Elevating Traders has access to data about your demo trades and may share this data with its affiliated entities. You are not entitled to any compensation related to our use of trading data.
- Prohibited Trading Practices: When demo trading, you agree not to engage in any of the prohibited practices as stated in the trading rules.
- Enrolment: Elevating Traders offers a Trader Evaluation Program in which users participate in a multi-stage evaluation of their simulated trading performance. There is an enrolment fee to participate which varies depending on the account size selected.
- Evaluation Stages: The Trader Evaluation consists of Apprentice and Intermediate stage. In each stage, you must meet specified profit targets and comply with risk management rules to advance. The specific parameters are available on our website.
- Completion: If you successfully complete the Evaluation Stages, no violation of trading rules occurs during the evaluation stage, Elevating Traders will move you to Elite stage, which allow you to earn rewards from your future simulation trades.
- Lawful Use: When using the Elevating Traders services, you agree to comply with all applicable laws and regulations. You may not use our services for any unlawful or abusive purpose.
- Prohibited Conduct: In addition to the prohibited trading practices described in section 5.3, you agree not to:
- Violate any intellectual property rights of Elevating Traders or third parties
- Attempt to gain unauthorised access to our systems
- Use our services to transmit spam, viruses, or malicious code
- Interfere with the security or operation of our services
- Impersonate another user or engage in fraud
The Elevating Traders website and services, including text, graphics, logos, and software, are the property of Elevating Traders and its licensors and protected by copyright and trademark laws. We grant you a limited license to use our services for their intended purposes in compliance with these Terms. You may not copy, modify, distribute, sell, or lease any part of our services without our prior written consent.
9. Termination
- This contract is valid until the completion or failure of the Challenge or Verification stage.
- Both parties may terminate the contract earlier, in accordance with these Terms and Conditions. The contract will automatically terminate with immediate effect if the Customer fails to open at least one demo trade within a 30-day consecutive period at any stage.
- Elevating Traders reserves the right to terminate this contract with cause and immediate effect if the provision of Services under the contract would hinder the ability to comply with legal obligations or orders and decisions from governmental bodies or other regulators.
- Either Party may terminate this contract without cause by providing 7 days written notice to the other Party in advance.
- Termination will not entitle you to any refunds of fees paid.
10. Disclaimers and Limitation of Liability
The Elevating Traders services are provided "as is" without warranties of any kind. We do not promise uninterrupted access or that our services will meet your requirements. To the fullest extent allowed by law, Elevating Traders will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses. In no event will Elevating Traders' aggregate liability for all claims related to the services exceed the greater of $100 or the amounts paid by you to Elevating Traders in the 12 months prior to the event giving rise to the claim.
11. Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement between you and Elevating Traders regarding your use of our services.
- Governing Law: These Terms are governed by the laws of the United Kingdom, without regard to conflict of law principles.
- Dispute Resolution: You agree to first try to resolve any dispute informally by contacting us.
- Changes to Terms: Elevating Traders may revise these Terms from time to time. We will notify you of material changes via the Client Portal or by email. By continuing to use our services after changes become effective, you agree to the revised Terms.
- Severability: If any part of these Terms is deemed invalid or unenforceable, that part will be construed in a manner consistent with applicable law and the remaining parts will remain in full force and effect.
